About us,

 DMFT & PMKKKY

District Mineral Foundations (DMF) is a trust, setup as non-profit body in all districts of Tamil Nadu, to work for the interest and benefit of persons and areas affected by mining related operations. It is funded through the contribution from every mines/quarry lease holder.

They derive their legal status from section 9B of Mines and Minerals (Development and Regulation) Act, 1957 as amended on 26 March 2015 as Mines and Minerals (Development and Regulation) Amendment Act, 2015.

This amendment came into force from 12th January 2015. The Government of Tamil Nadu Notification vide G.O. Ms. No. 57, Industries (MMD.1) 19th May 2017, enacted the Tamil Nadu District Mineral Foundation Rules, 2017 to establish District Mineral Foundation Trust in each district of the State as a non-profit body in the mining operation affected districts.

The Central Government has mandated the PMKKKY (Pradhan Mantri Khanij Kshetra Kalyan Yojana) to be implemented by the DMFs of respective districts using the funds accruing to the DMF.

ESTABLISHMENT:

 

As ordered by the Government and instructions of the Commissioner of Geology and Mining, the Chairperson of Chennai District Mineral Foundation Trust cum District Collector, “The Chennai District Mineral Foundation Trust” was Constituted on 09.10.2020.  As per the Tamil Nadu District Mineral Foundation Rules 2017, the committee has to be renewed / reconstituted within a term of 3 years.

Government of India has directed all state Government/Union Territories to incorporate Member of Rajya Sabha, Lok Sabha, Member of Legislative Assembly and Member of Legislative Council as a member of the Governing Council by incorporating in the rules regulating the composition of the Governing Council and Managing Committee of the District Mineral Foundation Trust.  Further, any meeting of Governing Council or Managing Committee of the District Mineral Foundation of a District held after issue of the said direction will be held with composition as mandated above.

The Government has made Amendments in the Tamil Nadu District Mineral Foundation Rules 2017 for the inclusion member of Lok Sabha, Rajya Sabha and Legislative Assembly in the composition of Governing council and Managing Committee of the District Mineral Foundation Trust reconstituted as per the amended Rules 2017 vide Chairperson of District mineral Foundation Trust / District Collector Proceedings Order vide R.C.No.C2/8138/2020 Dated:21.11.2024

 

OBJECTIVES OF DMF & PMKKKY

 

The object of the District Mineral Foundation is to work for the interest and benefit of persons, and areas affected by mining related operations in such manner as may be prescribed by the State Government

The Pradhan Mantri Khanij Kshetra Kalyan Yojana (PMKKKY) are implemented by the DMF’s of the respective districts using the funds accruing to the DMF. The overall objective of PMKKKY scheme are as follows:-

  1. To implement various developmental and welfare projects/programs in mining affected areas, and these projects/programs will be complementing the existing ongoing schemes/projects of State and Central Government.
  2. To minimize/mitigate the adverse impacts, during and after mining, on the environment, health and socio-economics of people in mining districts.
  3. To ensure long-term sustainable livelihoods for the affected people in mining areas.

(4) Without prejudice to sub-sections (1), (2) and sub-section (3), the State Government may, by notification, make rules for regulating the provisions of this Act for the following, namely:-

(a)the manner in which the District Mineral Foundation shall work for the interest and benefit of persons and areas affected by mining under sub-section (2) of section 9B;

(b)the composition and functions of the District Mineral Foundation under sub-section (3) of section 9B; and

(c)the amount of payment to be made to the District Mineral Foundation by concession holders of minor minerals under section 15A

 

PMKKKY Guidelines

 

Ministry of Mines has circulated guidelines for Pradhan Mantri Khanij Kshetra Kalyan Yojna (PMKKKY) on 16.09.2015 to be implemented by the District Mineral Foundations (DMF) for taking up development and welfare projects/programs in mining affected areas and other directions from time to time.

As per the guidelines, the DMFs have been instructed to spend majority of funds on the areas directly affected by mining i.e. areas where direct mining-related operations such as excavation, mining, blasting, beneficiation and waste disposal (overburdened dumps, tailing ponds, transport corridors etc.), etc. are located and a percentage of the funds on indirectly affected areas where local population gets affected on account of economic, social and environmental consequences due to mining-related operations.

Guidelines, PMKKKY 2015

 

The Mines and Minerals (Development & Regulation) Amendment Act, 2015, mandated the setting up of District Mineral Foundations (DMFs) in all districts in the country affected by mining related operations. The Central Government, notified the rates of contribution payable by miners to the DMFs. In case of all mining leases executed before 12th January, 2015 (the date of coming into force of the Amendment Act) miners will have to contribute an amount equal to 30% of the royalty payable by them to the DMFs. Where mining leases are granted after 12.01.2015, the rate of contribution would be 10% of the royalty payable. Using the funds generated by this contribution, the DMFs are expected to implement the PMKKKY.

The contribution to DMF is not related to utilization of DMF funds. Also, in exercise of the powers conferred by sub-sections (5) and (6) of Section 9B of the Mines and Minerals (Development and Regulation) Act, 1957, the holder of a mining lease or a prospecting license-cum-mining lease, in addition to the royalty, shall pay amount as prescribed under Mines and Minerals (Contribution to District Mineral Foundation) Rules, 2015 to the District Mineral Foundation.

 Guidelines, PMKKKY 2024

Section 9B of MMDR Act, 1957 empowers State Governments to establish District Mineral Foundation (DMF) to work for welfare and benefit of persons, and areas affected by mining related operations and make rules for composition and functions of the DMFs in the State.

In 2015, Central Government circulated Pradhan Mantri Khanij Kshetra Kalyan Yojana (PMKKKY) guidelines and further vide order dated 15.01.2024 Central Government revised the PMKKKY guidelines with directions to State Governments to incorporate the same into the DMF rules framed by them.

As per the PMKKKY guidelines 2024, at least 70% of the funds are to be spent on High Priority Sectors like drinking water supply, environment preservation and pollution control measures, health care, education, welfare of women and children, welfare of aged and differently abled, skill development and livelihood generation, sanitation, housing, agriculture, and animal husbandry. Up to 30% of the funds are to be spent on Other Priority Sectors like physical infrastructure, irrigation, energy and watershed development, and any other measures for enhancing environmental quality in the mining affected district.
